Rules: A regulation has been promulgated under these statutes, known as Title 23, Chapter 14, Nebraska Administrative Code - Garbage Feeding.
54-753.01. Feeding of garbage; definition.
(1) Except as provided in subsection (2) of this section, it shall be unlawful for any person to feed
garbage to animals.
(2) A person may feed garbage to his or her own animals so long as the garbage is obtained from the person's own household, and the animals so fed, if consumed, are consumed by no one other than the members of that household.
(3) As used in this section, garbage shall mean all waste material derived in whole or in part from fruits, vegetables, meats, or other plant or animal material, including poultry material, and any other refuse of any character whatsoever that has been associated with any such material, resulting from the handling, preparation, cooking, or consumption of food, except that such term shall not include material exempted by the Department of Agriculture in rules and regulations adopted pursuant to subsection (4) of this section.
(4) When deemed to be in the best interest of the livestock industry of the state, and not detrimental to the public health, safety, or general welfare, the department may adopt reasonable rules and regulations exempting specified materials from being deemed to be garbage under this section. Only materials of a nonmeat nature which are by-products of commercial food processing operations may be so exempted.
54-753.04. Feeding of garbage; violations; penalty.
Any person violating the provisions of section 54-753.01 or any rule or regulation made pursuant
thereto shall be guilty of a Class IV misdemeanor. Each day the provisions of section 54-753.01
or any rule or regulation made pursuant thereto is violated shall be a separate offense.
