Dealer - a person who doesn't grow nursery stock but acquires and further
distributes it.
A dealer can also be someone who uses nursery stock for landscaping on someone else's property
or distributes nursery stock with a tree spade. If the tree spade operator grows and distributes his
own trees, they can be licensed as a grower.
- Renewals for a dealer's license are automatically mailed out to previously licensed dealers.
These are delinquent after February 1. The delinquent fee is $20 per month for each month
delinquent. Initial applications need to be received before you begin distribution.
- You must list all sources of nursery stock on the application/renewal. These sources must
be continually updated with our department. Nursery stock sources must be licensed in the state
of origin. A tree spade operator should list the sources they move nursery stock from
repeatedly.
- The license fee for a dealer is $100 per year and must be paid at the time of application or
renewal.
- The dealer's license expires December 31 of each year.
- If you are distributing nursery stock from more than one location, you will need a dealer's
license for each distribution location. Door-to-door tree salesmen would need to acquire a
separate dealer's license for each location they distribute to.
- Dealers may be inspected and a "Withdrawal-From-Distribution Order" may be issued for
nursery stock that is restricted due to nonviability, plant pest problems, or with environmental or
mechanical damage. These restricted plants are marked with red restriction tape and cannot be
distributed until certain requirements have been met and the plants reinspected and released.
All nursery stock distributed by any grower, dealer, or broker must be sound, healthy nursery
stock that is reasonably capable of growth, labeled correctly, free from injurious plant pests, and
stored or displayed under conditions that maintains its vigor.
